1. Who we are

This website is operated by Solte Outdoor Enterprises LLC ("Sôltē", "we", "us"), PO Box 65, Aynor, SC 29511. By visiting livesolte.com or placing an order, you agree to these Terms of Service and to our Privacy Policy, Shipping Policy and Refund Policy, each of which is part of these terms.

If you do not agree to these terms, please do not use the site.

2. Who may order

You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order. By ordering you confirm that the information you give us is accurate and that you are authorized to use the payment method you provide.

3. Products, prices and availability

We try to show every product accurately, but screens vary and the color, texture and finish you see may differ from the boot in your hands. Product descriptions, specifications and prices can change without notice, and products may sell out or be discontinued.

Prices are in U.S. dollars and do not include sales tax, which is calculated at checkout where it applies.

If a product or price is listed in error, we may cancel the affected order even after you receive an order confirmation. If we do, we will tell you and refund you in full.

4. Orders

Your order is an offer to buy. The order confirmation email acknowledges that we received it, not that we accepted it. We accept your order when we ship it.

We may limit or refuse any order, including orders that appear to be placed by resellers or dealers, orders with quantities above normal personal use, and orders our fraud screening flags. We may also limit quantities by person, household or address.

5. Payment

Payment is processed by our payment providers at checkout. You authorize us to charge your payment method for the order total, including tax and any shipping charges shown at checkout.

6. Shipping, title and risk of loss

Shipping is covered by our Shipping Policy. Title and risk of loss pass to you when the carrier delivers your order to the address you gave us.

7. Returns, exchanges and the defect guarantee

Returns, exchanges and our manufacturing defect guarantee are set out in full in our Refund Policy, which governs those terms. Please read it before you order.

8. Disclaimer

Except for the defect guarantee described in our Refund Policy and any warranty you have under applicable law, the site and our products are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

Our products are footwear. They are not personal protective equipment, safety equipment or a substitute for safe practice on the water, and nothing on this site should be read as a safety claim.

9. Limitation of liability

To the fullest extent permitted by law, Sôltē and its owners, employees and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or loss of use, arising out of your use of the site or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

Some states do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnification

You agree to indemnify and hold Sôltē harmless from any claim or demand, including reasonable legal fees, arising out of your breach of these terms or your violation of any law or the rights of a third party.

11. Our intellectual property

The site and everything on it, including text, photography, video, graphics, logos and the names Sôltē, Deadrise and Soft Wake, are owned by or licensed to Solte Outdoor Enterprises LLC and are protected by intellectual property laws. You may not copy, reproduce or use any of it for commercial purposes without our written permission.

12. Content you submit

If you send us a review, comment, photo, video or suggestion, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify and display it in connection with our business, including in marketing, without compensation to you. You confirm that the content is yours to share, that it is accurate, and that it does not violate anyone else's rights. We may remove any submitted content at our discretion and we are not obligated to publish it.

13. Email and text messages

By giving us your email address you agree to receive order and service messages from us, and marketing email if you opted in. You can unsubscribe from marketing email at any time using the link in any marketing message.

If you opt in to text messages, you agree to receive recurring automated marketing and service texts at the number you provide. Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies. Reply STOP to cancel and HELP for help.

14. Acceptable use

You agree not to use the site for any unlawful purpose, to interfere with its operation or security, to scrape or harvest data from it, to introduce malicious code, or to impersonate any person.

15. Links to other sites

The site may link to third-party sites and services we do not control. We are not responsible for their content, products or policies, and a link is not an endorsement.

16. Changes to these terms

We may update these terms at any time by posting the revised version on this page with a new date. The version in effect when you place an order governs that order.

17. Governing law

These terms are governed by the laws of the State of South Carolina, without regard to its conflict of laws rules. Any dispute arising out of these terms or your use of the site will be brought in the state or federal courts located in Horry County, South Carolina, and you consent to the jurisdiction of those courts.

18. General

If any provision of these terms is found unenforceable, the rest remain in effect. Our failure to enforce any provision is not a waiver of it. These terms, together with the policies they reference, are the entire agreement between you and us about the site and your orders.
